[Seminar] Legal Issues in the Proposed Class Action Act and Measures to Prevent Abuse

jo_imgjo_imgjo_imgjo_imgAt this seminar, we examined the current status of discussions on introducing a class action system and the limitations of the current damages framework, and centered the discussion on a balanced legislative direction that considers not only a victim-relief-oriented institutional design but also the prevention of litigation abuse and the stability of corporate management. We also diagnosed the structural problem whereby expanded access to litigation could instead lead to excessive lawsuits and coerced settlements, and reviewed ways to build an effective collective rights relief system suited to the realities of Korea’s judiciary by referring to how major countries such as the United States, the United Kingdom, and Germany operate class action and representative action systems. The event concluded successfully as a venue for sharing key issues and policy implications.
