[Seminar] Issues and Alternatives in the Proposed Class Action Act

The Center for Free Enterprise (CFE), together with member of the National Assembly Gyutaek Kwak, held a policy seminar titled “Issues and Alternatives in the Proposed Class Action Act” on Wednesday, September 30, 2026, at 9:30 a.m. in Conference Room 7 of the National Assembly Members’ Office Building.

At this seminar, participants expressed sympathy with the original purpose of introducing a class action system—the need to provide meaningful relief for victims suffering small but widespread losses—while also discussing key issues that should be considered in adopting the system, focusing on problems such as retroactive application, the opt-out method, and overlapping liability with existing surcharges and punitive damages. In addition, a range of views was presented on directions for institutional improvement that would take into account both victim relief and legal stability, including giving priority to reviewing an opt-in approach and gradually expanding the scope of application.
