※Book Introduction

: As can be seen from the author’s career, this book was written primarily for legal professionals. The many different areas of law that exist in the real world contain a wide variety of legal doctrines. The author seeks to explain these diverse doctrines within a consistent framework. The tool used for this analysis is, needless to say, economics. However, the economic concepts used in this book are not particularly difficult. Nor does it rely on mathematical formulas, which often make economics seem harder to approach. Drawing on his extensive knowledge of economics and citing a wide range of judicial precedents, the author presents his arguments persuasively. The core of the logic he advances is the maximization of wealth. In other words, underlying all law is the logic of wealth maximization.


※About the Author

: Richard A. Posner was born in New York in 1939 and graduated from the Department of English at Yale University and Harvard Law School. He later served as a clerk to a U.S. Supreme Court Justice, assistant to a hearing examiner at the Federal Trade Commission, and assistant to the U.S. Deputy Attorney General, and also taught as a law professor at Stanford University. His major works include Antitrust Law, Law and Economics, The Economics of Justice, Law and Literature, Sex and Reason, and Tort Law.
